Mediation

Attorneys Elliott Werth and Kalina Vajskop are certified mediators who can assist parties in disputes by facilitating communication to allow them to reach a mutually agreeable outcome.

 

Mediation has many benefits. Mediation can be less expensive than traditional litigation, and resolutions can often be reached much more quickly than they would be on a court’s docket. A mediator does not take sides or decide who would “win” the case, but rather the goal of mediation is to allow each party to be heard and to see if the parties can tailor their own resolution, which can be more flexible and creative to meet their specific needs. This process allows the parties to retain control of their case and its outcome, rather than leaving it to a judge or a jury.

 

Your case can be mediated at nearly any point in time during your dispute. Our firm can schedule a mediation prior to any documents being filed with a court to see if the parties are able to reach a resolution absent court involvement. Mediations can also be scheduled for a pending case to help parties avoid a final hearing or limit the issues that the court would need to hear. If mediation is not successful, then either party still has the opportunity to seek or continue court involvement. Regardless of whether a case was already pending, the mediation process is confidential, so neither party can utilize what is said at mediation against the other if court intervention is necessary.
